Gurgaon Court Denies Anticipatory Bail to TV Anchor Chitra Tripathi

Gurgaon: A Gurgaon court has rejected the anticipatory bail application of TV news anchor Chitra Tripathi in connection with a 2013 Protection of Children from Sexual Offences (Pocso) Act case. The court observed that the reasons cited in the bail plea were “unjustified.”

On November 14, the court had issued a non-bailable warrant against Tripathi for not appearing before it, stating that she was taking the proceedings “quite lightly.” A similar warrant was issued against Syed Suhail, another news anchor.

The case, registered in 2013, involves allegations against eight media professionals for telecasting and uploading a video of a 10-year-old girl in an “obscene and vulgar manner” in connection with a sexual assault case against self-styled godman Asaram Bapu. Charges include sections 120B, 469, and 471 of the IPC; sections 67B and 66(2) of the IT Act; and section 23 of the Pocso Act, which penalizes disclosure of a child’s identity.

Tripathi had sought exemption from court attendance, citing her travel to Nashik for covering Maharashtra Assembly elections and interviewing political leaders Ajit Pawar and Eknath Shinde. However, the court found her explanation insufficient and noted that her prior absence was excused on health grounds.

On November 25, the Additional District and Sessions Judge Ashwani Kumar denied her bail, stating the reasons for her absence mirrored earlier unjustified grounds. The court emphasized that her respect for legal proceedings seemed lacking and underscored the need for expeditious case disposal given its nine-year pendency.

Tripathi presented flight tickets and photographs of her interviews as evidence, but the court remarked that the interviews could have been pre-scheduled and that she should have sought exemption earlier if she respected court procedures.

The court ordered the station house officer to execute the warrant and appear personally if the warrant remains unexecuted.
